These Terms of Service ("Terms") govern your access to and use of rootedpouches.com (the "Site") and any products, services, or content offered by Rooted Pouches ("Rooted," "we," "us," or "our"). By accessing or using the Site, or purchasing our products, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase from us.

1. Eligibility and Age Requirement

By using the Site or purchasing our products, you represent and warrant that you are at least 21 years of age and have the legal capacity to enter into binding agreements. Rooted Pouches products are intended for adult use only. We reserve the right to refuse service or cancel orders if we have reason to believe a customer does not meet our age requirements.

2. Our Products

Rooted Pouches manufactures and sells nicotine-free oral pouches formulated with kava and other functional ingredients. Our products are intended as adult wellness and lifestyle products. They are not tobacco products and do not contain nicotine.

Health Disclaimer. Statements about our products have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. 3. Account Registration

4. Orders, Pricing, and Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, age verification failures, or shipping to restricted jurisdictions.

Prices are listed in U.S. dollars and are subject to change without notice. You are responsible for all applicable taxes and shipping charges. Payment is processed through secure third-party providers. By submitting an order, you authorize us to charge your payment method for the total amount of your order.

5. Shipping and Delivery

We ship within the United States to addresses where the sale and shipment of our products are legal. Shipping times are estimates and not guaranteed. Risk of loss passes to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, or events outside our control.

It is your responsibility to confirm that our products are legal to purchase, possess, and use in your state, county, or municipality.

6. Returns and Refunds

Due to the consumable nature of our products, all sales are final. We do not accept returns on opened products. If your order arrives damaged, defective, or incorrect, contact us at contact@rootedpouches.com  within 7 days of delivery and we will work with you to make it right.

7. SMS Messaging Terms

By providing your phone number and opting in to SMS communications, you agree to receive recurring automated marketing and transactional text messages from Rooted Pouches at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.

To opt out, reply STOP to any message. For help, reply HELP. We may also send transactional messages related to your orders that are not subject to opt-out. See our Privacy Policy for details on how we handle phone number information.

8. Marketing Communications

By providing your email address, you consent to receive marketing emails from Rooted Pouches. You may unsubscribe at any time using the link in any marketing email. Transactional emails related to your orders are not subject to unsubscribe.

All content on the Site, including text, graphics, logos, product names, images, and the "Stay Rooted." tagline, is the property of Rooted Pouches or its licensors and is protected by copyright, trademark, and other intellectual property laws. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROOTED POUCHES, ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Rooted Pouches and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your purchase or use of our products, your violation of these Terms, or your violation of any rights of another.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law principles.
